The nature of the copyrighted work: Courts will consider whether the original game is a creative work or a factual work. Creative works receive more protection under copyright law than factual works.
The amount and substantiality of the portion used: Courts will consider how much of the original game is used in the fanfix and whether the fanfix uses the most important or creative elements of the original work.
