Kay Flock was arrested on December 15, 2021, and charged with murder in the shooting death of 24-year-old Oscar Hernandez. The arrest came after a months-long investigation by the NYPD. Flock has been held at Rikers Island since his arrest and has pleaded not guilty to the charges.

The arrest date is a significant factor in determining Kay Flock's prison release date. Under New York law, a defendant who is convicted of murder can be sentenced to up to 25 years in prison. However, the actual sentence will depend on a number of factors, including the defendant's criminal history and the circumstances of the crime.

In Kay Flock's case, the prosecution is likely to argue for a lengthy sentence, given the seriousness of the crime. However, Flock's defense attorneys may be able to argue for a more lenient sentence, based on Flock's lack of a prior criminal record and his age at the time of the crime.

Ultimately, the decision of how long Kay Flock will spend in prison will be up to the judge who presides over his case. The judge will consider all of the evidence presented at trial, as well as the arguments of the prosecution and defense, before making a decision.

Charges

The charges against Kay Flock are extremely serious. Murder is a class A-1 felony in New York State, and it is punishable by up to 25 years to life in prison. The fact that Flock has been charged with murder means that he could face a lengthy prison sentence if he is convicted.

The prosecution will likely argue that Flock should receive the maximum sentence possible, given the seriousness of the crime. They will point to the fact that Flock allegedly shot and killed the victim, Oscar Hernandez, in cold blood. They may also argue that Flock has a history of violence, and that he is a danger to society.

Flock's defense attorneys will likely argue that he should receive a more lenient sentence. They may point to the fact that Flock has no prior criminal record, and that he was only 18 years old at the time of the crime. They may also argue that Flock was acting in self-defense, or that he was under the influence of drugs or alcohol at the time of the crime.

When a defendant pleads not guilty, it means that they are denying the charges against them. This is a common plea in criminal cases, and it is often used as a way to preserve the defendant's rights and options.

In Kay Flock's case, pleading not guilty means that he is denying the charges of murder against him. This plea will allow him to go to trial and present his defense. If he is found not guilty, he will be acquitted of the charges and released from prison.

If Kay Flock is convicted of murder, he could face a lengthy prison sentence. However, pleading not guilty gives him the opportunity to fight the charges and potentially avoid a conviction.

It is important to note that a plea of not guilty does not mean that the defendant is innocent. It simply means that the defendant is denying the charges and wants to go to trial.

Trial Date

The trial date for Kay Flock's case has not yet been set. This is not uncommon in criminal cases, as it can take months or even years for a case to go to trial. There are a number of reasons why a trial date may not be set, including the complexity of the case, the availability of witnesses and attorneys, and the backlog of cases in the court system.

Complexity of the case: Kay Flock's case is complex, involving a murder charge. The prosecution and defense will need time to gather evidence, interview witnesses, and prepare their arguments.
Availability of witnesses and attorneys: The trial date will need to be scheduled around the availability of witnesses and attorneys. This can be difficult, especially if the witnesses or attorneys are from out of town.
Backlog of cases: The court system is often backlogged with cases, which can delay the scheduling of trial dates. This is especially true in large urban areas like New York City, where there are a high number of criminal cases.

The fact that Kay Flock's trial date has not yet been set does not mean that he will not go to trial. It simply means that the court has not yet scheduled a date for the trial. Kay Flock will remain in jail until his trial date is set and he is either convicted or acquitted of the charges against him.

The length of Kay Flock's sentence will depend on a number of factors, including his criminal history, the circumstances of the crime, and the arguments of the prosecution and defense. However, the potential sentence of 25 years in prison is a reminder of the serious nature of the charges against him.
